DMCA Policy

1. Our Commitment
InstantTools respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (“DMCA”), we will respond promptly to claims of copyright infringement committed on our website (the “Site”) that are reported to our designated agent.
This policy describes how copyright holders can notify us of allegedly infringing material, how we respond to such notices, how accused parties can submit a counter-notification, and how repeat infringers are handled.
2. Filing a Takedown Notice
If you are a copyright owner — or authorized to act on behalf of one — and you believe that material accessible on or from InstantTools infringes your copyright, you may submit a written notification of claimed infringement (“Notification”) to our designated agent listed below. Your Notification must include all of the following to be effective under the DMCA:
- A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed;
- Identification of the copyrighted work claimed to have been infringed, or if multiple works at a single online site are covered, a representative list of those works;
- Identification of the material claimed to be infringing and reasonably sufficient information to permit us to locate it, such as the full URL;
- Contact information for the complaining party, including full legal name, mailing address, telephone number, and email address;
- A statement that the complaining party has a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and
- A statement, made under penalty of perjury, that the information in the Notification is accurate and that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be liable for damages.
3. Designated Agent
Notifications that satisfy the requirements above should be sent to our designated DMCA agent:
Please include “DMCA Takedown Notice” in the subject line so we can route your message appropriately. Email is the fastest way to reach us; we cannot guarantee timely handling of postal mail.
4. Counter-Notification
If you believe material you posted was removed or disabled in error or as a result of misidentification, you may file a counter-notification with our designated agent. A valid counter-notification must include:
- Your physical or electronic signature;
- Identification of the material that has been removed or to which access has been disabled, and the location at which it appeared before it was removed or access disabled;
- A statement, made under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification; and
- Your name, address, telephone number, and a statement that you consent to the jurisdiction of the federal court in the district where you reside (or, if your address is outside the United States, in any judicial district in which InstantTools may be found), and that you will accept service of process from the person who provided the original notification or an agent of that person.
If we receive a valid counter-notification, we will forward a copy to the original complainant. Unless the complainant files a legal action within 10 business days seeking a court order against you, we may restore the removed material at our discretion.
5. Repeat Infringers
Consistent with the DMCA and other applicable law, InstantTools has adopted a policy of terminating, in appropriate circumstances and at our sole discretion, any user or contributor who is deemed to be a repeat infringer. We may also, in our sole discretion, limit access to the Site for any user who infringes the intellectual property rights of others — whether or not there is a repeat infringement.
6. A Note on File Processing
InstantTools tools process files entirely in your browser. We do not upload, host, or index the files you convert, compress, or otherwise manipulate. DMCA notices should therefore target content published on the Site itself — such as guides, blog articles, images, or embedded demos — rather than transient files a user may process locally.
